The Southeast Natural Products Association (Southeast NPA) is the southeast region of Natural Products Association (formerly NNFA) (est. 1936) and serves Alabama, Florida, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, Puerto Rico and the Virgin Islands.

After contacting the Department of Business and Professional Regulations, here is the answer I received regarding your concerns about Florida Statute 561.02. I hope this information is helpful to you.

The Department of Business and Professional Regulations (DBPR) indicated that this issue was brought to the attention of the DBPR Division Alcoholic Beverages and Tobacco (ABT) by the Department of Agriculture (DACS) when DACS was inspecting health food stores and found tinctures with 60-75% alcohol mixed with herbs. ABT has purchased some of these products for research purposes and noted that product directions indicate to mix with water or juice as you would with an alcoholic beverage. ABT has since determined that these products are not under their regulatory jurisdiction.

They did issue some notices to cease and desist which should be rescinded within the next few days.
